Homicide
The two crimes, murder, and manslaughter constitute homicide. Murder is a very clear term and can be conducted in various ways, while manslaughter can be done in three ways. The first one is killing with a direct intention for murder, but the victim has offered resistance. The second is gross negligence that caused death can come under the head. Furthermore, there is the case of any conduct that ultimately takes an unlawful turn and finally causes death is called manslaughter. Other aspects like infanticide or dangerous driving can be termed as manslaughter.
Prosecution
The prosecution in all the cases must show a causal link between the criminal act and the death which will help to prove that the accused is guilty. He will have to be careful on the aspect that the act of the person must have a substantial reason for the death of the victim. However, if he can prove that it is the only or the most important cause for the death of the person that will be better. Generally, it does not matter in the aspects of the prosecution that if the act of the defendant just “hastened” the death of the victim.
Burglary
The crime of breaking and entering into a house with the intention of some crime is generally termed as burglary. Breaking in an automobile or an unoccupied household can also be termed under the same name. If arrested for the crime, in most of the cases the accused is taken to a court where in the first case he is granted bail but the accused has to give a determined bail amount to the court. Later, the dates of the trial are declared. In the case of burglary, the prosecutor must have to produce evidence so that the judge understands that there is enough evidence to carry on the case unless the case is dismissed.
Special Ethical Considerations
In both the cases we are dealing with, homicide and burglary are very serious crimes as per the law of any country. So, the prosecutors, while working in the cases have to be especially careful regarding different aspects. And the ethical issue is one of the very important aspects of them.
The prosecutor has to be thoroughly up to date with the process of the crime and all the recent developments in the sphere of the law of the country. This will help him to deal with cases making all the different points easy for him. Moreover, he has to think about the conditions of the victim or the victims and their subsequent families and therefore reinforce the gravity of the crime in the court.
